Committee Chair Don Meyer called the meeting to order at 3:30 p.m.

 

APPROVAL OF MINUTES

MOTION by Bina/Keil to approve meeting minutes of June 2, 2008.  Motion carried unanimously; Manthei and Rauk excused.    

 

PUBLIC COMMENT

Deborah Kelly, W4266 County Road M, La Crosse and a resident of Golden Valley Mobile Home Park, spoke in relation to the zoning and health related violations of the mobile home park.  As a tenant of the park, she also wants it cleaned up.

 

GOLDEN VALLEY MOBILE HOME COURT VIOLATIONS UPDATE

Chad VandenLangenberg, Code Enforcement/GIS Specialist, gave a verbal update as well as distributed a 2-page memo addressed to the committee that related to Golden Valley Mobile Home Park background, case history, current events, enforcement issues, looking ahead, and other impacts.  The park is located in the Town of Greenfield which has 52 mobile home sites.  Staff first visited the park in 2006, and again in 2007, in which citations were issued; but since the flood in August 2007, the County has become more involved as the well was contaminated and there were other issues relating to number of automobiles, junk piles that included appliances, tires, wood, skirting, etc.  As of July 1, 2008, and after consulting with the Health Dept., there is possibility of issuing 11 citations.  Jeff Bluske noted the park has a set of rules for the tenants to adhere to, but those aren’t being enforced either.  There is a new owner/lessee that is willing to make progress; the new owner/lessee has hired an on-site manager which will help with these issues.  Supervisor Freedland spoke on behalf of the tenants in the park and asked on-going assistance.  Committee Chair Meyer requested an update from staff at the next committee meeting.  

 

REVIEW AND APPROVE THE EROSION CONTROL PLAN FOR THE BATTLESTONE NORTH CONDOMINIUM PLAT, TOWN OF SHELBY

Mary Jo Webster reviewed the erosion control plan for Battlestone North Condominium Plat that is located in Town of Shelby.  This plan includes units 23-31(9 single family units).  The area being graded consists of approximately 5.5 acres – this does not include the area set aside for the septic fields.  The runoff from the two and 10-year (24 hour) storm events is being controlled by detention ponds.  The ponds will safely pass the 25-year (24 hour) event.  The plan, as submitted, allows a maximum of 4 building sites to be active at any given time.  It is recommended that the maximum number of sites open be set at 3 due to the extensive grading.  Staff also recommends the drainfields be constructed prior to any buildings being started. 

 

Mary Jo noted that with the conditions as stated below, the proposed units 23 through 31 of Battlestone Condominiums will meet the requirements of Chapter 21 of the County Code of Ordinances; she also noted that the DNR also needs to approve the plan.  Additional conditions as follows:

·         Construction staking is to be conducted by the designer of the plan – all swales, ponds and building elevations are to be constructed according to the plan – prior to advancing to each step in the sequencing, the completed step is to be checked for final grade accuracy. 

·         Maximum of three building sites being active at any one time.

·         Soil tests as required in technical standard 1001 - Wet Detention Ponds are to be completed and submitted for review; if any alterations to the plan are required after review of the soils tests, revisions are to be made, re-submitted for review and a re-submittal fee will be assessed.  No work can start until after review of soils tests.

·         Ponds are to be constructed according to the 1001 standard.

·         No land disturbance shall occur until after an on-site preconstruction conference that includes the erosion control plan designer, the contractor(s), and Land Conservation Dept. staff. 

·         All septic fields shall be installed prior to the construction of any buildings.  Construction of the drainageway below septic field will have to be done in conjunction with the installation of the mounds. 

·         Sequencing - after the septic fields are installed (including construction of drainageway below septic area) in the following order:

1.            Drainageway above septic is to be constructed and stabilized.

2.            The ponds are to be constructed and stabilized.

3.            Cul-de-sacs and grading between Battlestone Station Road and cul-de-sacs to be completed and stabilized.  This includes small pond, outlet pipe and drainageway to the east of the septic.

4.            Current plans are for Unit 27 to be the first unit constructed.

§         Prior to construction of unit 27, sediment controls are to be in place above drainageways.

§         Drainage swales adjacent to the building are to be installed as soon as final grade is established – extreme care needs to be taken to protect drainage swales below structure.

5.            All drainageways between structures are to be stabilized as soon as final grade is established.

6.            Owner is responsible for contacting the Land Conservation Dept. as each of the above steps are completed so an inspection can be made prior to moving to the next step.

·         Additional measures, beyond those indicated in the conditionally approved plan, may be required if potential for off-site impacts become apparent.

·         An inspection made in September 2008 will determine what may be necessary to prepare the site for winter stabilization.

·         A final inspection, including the owner (or their representative), and Land Conservation staff shall occur at the end of the project or at the end of each phase.  The permittee is also required to provide the Land Conservation Dept. with as-built plans to verify that the stormwater plan had been installed as designed. 

·         Recommends the committee require a surety bond for this project, per section 21.10(5)(b) of Chapter 21 of the County Code of Ordinances.  The amount of the bond will be determined after a copy of the accepted bid for earth work has been submitted. The bond shall include all work necessary to stabilize the site including grading according to the submitted erosion control and stormwater plan, and a fee for the cost of the County to oversee the required completion of the plan.

 

Miscellaneous questions and answers – some relating to long term erosion issues.  Mary Jo noted a lot of activity in a small area, but upon following the stated conditions, the plan meets requirements.  MOTION by Keil/Rauk to approve the erosion control plan for the Battlestone North Condominium Plat located in Town of Shelby, including the above stated conditions and the requirement of a surety bond.  Motion carried unanimously; Manthei excused.  

 

PROPOSED CONDITIONAL USE PERMIT FACTS, ISSUES SHEET, AND QUESTIONNAIRE

Jeff reviewed the Conditional Use Permit fact sheet and the questionnaire that will be required to be filled out by the applicant which will assist staff and the committee in the decision-making process.  Jeff asked for input.  Supervisor Rauk said another question is, “have to you talked to your neighbors?”  General agreement by committee members to include copies of the filled out questionnaires along with the impact statements.

 

SET POLICY FOR ZONING APPLICATIONS THAT DO NOT COMPLY WITH COUNTY AND TOWN LAND USE PLANS

Jeff reviewed the flow chart relating to the five (5) steps for rezoning and conditional use permit applications; these five steps will help guide the committee through the process.  He asked for input.  Charlie noted statutorily, citizens have the right to make application.  Discussion and questions on the process, and in particular, relating to “consistent with town board plans.”  Determination of consistency is solely a decision to be made by the town board and by the County Board.  Supervisors Rauk and Pedretti suggested changes to the chart, under step 2, change the wording to “Denied by Town Board”, under step 4, change wording to “Denied by County Board”, and in step 5, change to “Approved” and “Denied”.  Committee Chair Meyer suggested this policy or process be presented to the County Board at a future County Board Planning session.    

 

UPDATE ON DEPARTMENTAL CODE OF ORDINANCE CHANGES

Jeff distributed a handout relating to needed revisions to Chapter 16, 17 and 20 of the County Code of Ordinances; most relate to Chapter 17, the Zoning Code.  Staff suggests doing the revisions in 3 phases:  1) definition updates, 2) revisions, and 3) additions.  There is a balance of about $9,000 in the Comprehensive Planning account for the consultant (Schreiber, Anderson & Assoc.) as they have agreed to assist in this updating - checking for needed revisions to the chapters as mentioned.  Jeff asked for input on how to handle.  After some discussion, general agreement by the committee to do all of the needed updates/revisions and bring back to committee.

 

ACT ON TOWN OF ONALASKA’S RECOMMENDATIONS FOR DAVE HARTER ZONING PETITION NO. 1780

Jeff noted due to no correspondence from the Town of Onalaska prior to the June 2, 2008 public hearing, the David Harter Zoning Petition No. 1780 was held over.  Details of Zoning Petition #1780 as follows:  David Harter, member Marvin Gardens Development LLC, W5726 Koss Road, Onalaska WI  54650; acting on behalf of Delores M. Steck, N5592 Hauser Road, Onalaska WI  54650.  Petition to rezone from the Exclusive Agricultural District to Residential District “A” an approximately 9.5-acre parcel lying above Schultz Drive, for an approximately 11 lot subdivision on land described as:  The North 6 acres of the NE-SW and that part of the SE-NW lying southerly of a tributary to Sand Lake Creek, all in Section 27, T 17 N, R 7 W, Town of Onalaska.  Committee vote at the public hearing was 4 in favor and 3 opposed.

 

The Town of Onalaska has since met and per recent correspondence, they unanimously approved the rezoning.  Three committee members Rauk, Bina and Mach spoke in relation to their opposition votes at the public hearing – most reasons related to no correspondence from the Town of Onalaska.  MOTION by Pedretti/Keil to reaffirm committee action on June 2, 2008, that being:  to approve Zoning Petition #1780 as presented by David Harter, member of Marvin Gardens Development LLC, W5726 Koss Road, Onalaska WI  54650, acting on behalf of Delores M. DISCUSS COMMITTEE MEMBER APPOINTMENT TO THE LAKE ONALASKA REHABILITATION AND PROTECTION DISTRICT

Jeff noted per the County Code of Ordinances, it states that a member of this committee should serve on the Lake Onalaska Rehabilitation and Protection District and same for Lake Neshonoc District.  Vicki Burke who served on the PRD Committee some time ago, was the committee’s representative on the Onalaska Lake District, but she is no longer a member of this committee.  Options could be:  is there a member of PRD Committee interested in serving on the Onalaska Lake District or take a vote and approve Supervisor Burke as the PRD Committee representative.  Committee Chair Meyer directed Jeff to check with Corporation Counsel if the rule could be amended or how to handle.

 

LA CROSSE-BAD AXE UW EXTENSION BASIN EDUCATOR – RANDY MELL

Randy Mell distributed informational brochures.  He is one of fifteen basin educators located in Wisconsin.  The UW Extension Basin Education Initiative, in cooperation with the WI DNR, designs and delivers educational programs, assists organizations, and builds partnerships to promote understanding and stewardship of Wisconsin’s natural resources at the watershed and landscape scale.  The educators provide expertise in:  1) natural resources issues, 2) group process and facilitation, 3) organizational capacity building, 4) adult education principles, and 5) educational program design/implementation.  The area office is located in Black River Falls and also pursuing a satellite office in La Crosse.
