CALL TO ORDER

The recessed meeting and Public Hearing of the Planning, Resources and Development Committee was called to order at 6:00 p.m. by Vice Chair Tom Rauk.  Let the record show that this meeting is called in full compliance with the requirements of the Wisconsin

Open Meetings Law.  The procedures for tonight’s meeting are explained to those gathered.  This meeting is being recorded.

 

REQUEST TO WITHDRAW CONDITIONAL USE PERMIT NO. 769   Brian and Janice Strupp, N6780 Briggs Rd, Holmen WI  54636.  Petition to store equipment inside and outside associated with the Strupp Trucking Company in an existing 50’ x 70’ barn at N6722 Briggs Road and to use an existing 30’ x 33’ pole shed for rental storage space at N6780 Briggs Road, on 3.41 acres zoned Agricultural District “A” and described as: Lots 1 and 2 of Certified Survey Map No. 156 Volume 8.  Town of Holland.

Answer MANSKE:  Could but that’s in field hard to farm around something like that.

Department Recommendation:  Approve with 7 conditions:

  1. Permit is granted to allow for excavation of borrow materials on 4.96-acre site only (includes Parcels A & B).  Citations will be issued anytime soil is removed outside these two parcels.

  2. Survey markers are currently absent and are required at all times to mark outside boundary.

  3. An approved Erosion Control Permit is required from La Crosse County Department of Land Conservation prior to any soil removal.

  4. Approved Stormwater Permits are required for both Parcels A & B prior to any soil removal and Parcel B requires a Chapter 30 DNR permit prior to any earthwork.  Copies of these 2 permits shall be made part of this file.

  5. Payment of the review fee of $200 is due prior to issuance of Nonmetallic Mining Permit. 

  6. This permit expires July 31, 2012.

  7. This permit is non-transferable.

Question BINA:  Could Les farm this?

Answer BLUSKE:  Mr. Manske only disturbing 1 acre at a time so 4 acres more or less will be farmed.

Question Pedretti:  Should condition number 2 be amended then?

Answer BLUSKE:  Will work with Mr. Manske on that, Land Conservation has to determine area disturbed each year.

NONMETALLIC MINING RECLAMATION PERMIT NO. 2008-25  Leslie J. and Nancy J. Manske, W 4839 Chipmunk Rd N, Stoddard WI  54658.  Petition to hear reclamation matters relating to removal of borrow materials from land zoned Exclusive Agricultural District which fall under the regulation of Chapter 27 of La Crosse County’s Code of Ordinances – Nonmetallic Mining Ordinance, at the following location: (same description as in Conditional Use Permit No. 762).  Town of Shelby.  This parcel is also subject to any conditions placed on it from said Conditional Use Permit No. 762.  Estimates of reclamation costs, erosion control, financial assurance and topography will be discussed.

Question RAUK:  Is that ½ acre per year?

Question MANSKE:  Could that be 7 years instead of 5 years?
Answer BLUSKE:  Could come back in 2012 to amend.

Correspondence:  Land Conservation recommends approval with 7 conditions:

1.      All areas of disturbance shall be internally drained.

2.      Limits of phase one will be marked by setting a minimum of three steel fence posts to delineate the 300 foot setback from the stream.

3.      If at anytime the areas disturbed for the purpose of topsoil removal should not be internally drained, a stable berm is to be created to prevent any flow into the adjacent stream.

4.      Area will be restored to existing grade and drainage by placement of clay material with a minimum of 8 inches of topsoil.

5.      Due to the nature of the soil being used as backfill, if production of crops is not 70% or greater of the original production level (100+ bu/acre) sub-soiling to encourage infiltration may be required.

6.      This reclamation plan indicates that no more than one acre will be disturbed at any given time.

7.      A financial assurance is to be supplied in the amount of $230/acre and payment of the review fee of $200 is required prior to issuance of the Nonmetallic Mining Permit.

Appearing in Favor:  David Hammers, 250 Kevin Court, Onalaska WI  54650.  Have purchased entire farm - 135 acres plus or minus, have divided farm into 4 parcels for recreation or possible building sites.  This 30.3 acres is remaining with the farm buildings on it.  Would sell as a hobby farm.  Also requesting approval for a private paved blacktop road to serve three 35-acre parcels, roadway would be located on this parcel – 66-ft easement would be set aside.

 

Question BLUSKE:  Have a letter from Bosshard Parke Law regarding Wolf agricultural access easement?

Answer HAMMERS:  We are aware of that and we plan to honor that, this will not affect that access.

CONDITIONAL USE PERMIT NO. 772  William and Doreen Heider, W4431 State Road 16, West Salem WI  54669.  Petition to operate an excavation business, to store equipment in four existing accessory buildings and to do maintenance on the equipment at this address on land described as:  The North ½-NW-NW of Section 5, T 16 N, R 6 W lying south of State Road 16.

Town of Hamilton.

 

Appearing in Favor:  William Heider, W4431 State Road 16, West Salem WI  54669.  Wish to use existing buildings to run excavating business.  Surrounded by housing, no longer milking cows, looking to make a living another way.  Mr. Bluske asked where will you store equipment.

(Heider indicates 5 existing buildings that will be used.)  Mr. Bluske is concerned about how this looks.  Frankly I am too.  Can plant screening so equipment out of view.  Still run 300 acres of crops.

 

Question BINA:  You say you’re not farming, but a lot of farm equipment is still there.

Answer HEIDER:  Still have 300 acres of crops.

 

Richard Schomberg – Town Chair, W3679 County Road C, West Salem WI  54669.  Town Board has approved 2 to 1.

 

Opposition:  None.

 

Correspondence:  1.  Letter from Town Clerk – Town has approved.  2.  Letter from Boundary Area Advisory Committee.  Recommend approval with 3 conditions:

1)     It is important to the Boundary Agreement Advisory Committee (BAAC) that this area retain its agricultural character.  The applicants proposed conditional use activity is considered by this committee to be an appropriate agricultural transitional use and therefore we support an approval of this conditional use permit with the following conditions.

2)     Outside storage of fill or landscaping type of material is allowable up to 200 c.y.

3)     Outside storage of operable excavation equipment is acceptable.

 

Department Recommendations:  Approve with 14 conditions:

 

1.      Permit is granted to allow for the operation of an excavation business on lands as designated on Heider’s site plan attached.

2.      Permit also allows the storage and maintenance of the following list of equipment only:

·         1 – end loader

·         1 – tractor backhoe

·         3 – tracked excavators

·         2 – dump trucks

·         1 – one ton truck

·         2 – trailers

·         1 – grader

·         Miscellaneous attachments for the above equipment and supplies

3.      All equipment listed can be stored outside or in the four existing agricultural building designated for storage use.

4.      Only one entrance is approved for this business, that being the existing residential driveway which will need an approved DOT permit to change the use to a combination residential and commercial driveway access.

5.      2 employees are permitted with this business.

6.      Hours of operation:  Sunrise to Sunset.

7.      The existing unlighted dairy farm sign may be used to advertise the business.

8.      A stockpile of not more than 200 cubic yards of sand may be maintained in the flat area west of the shed marked ‘vehicle maintenance’ designated on Heider’s site plan.  No deleterious or contaminated soil is allowed to be stored on site.

9.      Washing of equipment is allowed inside only with a system approved by state and county authorities.

10.  No burning is allowed on site and a commercial dumpster is required for refuse generated from the business.

11.  A state tax identification number is required, along with all equipment being reported to the local assessor each year right after January 1st.

12.  The site shall be maintained to look residential and agricultural at all times and give no impression of being commercial.  The Heiders must preserve the rural look of the farm.  This farm business is still the primary use.

13.  A hedgerow of trees is required along the top of the bank wherever commercial equipment is stored.

14.  This permit is non-transferable.

Answer FELKER:  We are abandoning that existing well and installing a new well which will comply with code requirements.

Department Recommendation:  Approve with 4 conditions:

1.      This permit is granted specifically for removing the existing home and foundation and ground cover and to bring in clear fill to conform with the required regional flood elevation, in order to construct a new engineered foundation and single-family home.

2.      This permit is subject to the owner or consultant receiving and maintaining an approved erosion control permit from La Crosse County Department of Land Conservation.

3.      Any employee of this department or that of Land Conservation shall be allowed access to this project site for inspection of permit compliance.

4.      This permit expires July 31, 2009.

1)     This permit is granted specifically to re-grade and re-shape an outdoor amphitheater to include new seating, a stone backdrop, to construct two 8-ft x 8-ft utility buildings and one 8-ft x 16-ft sound booth in the Shoreland District of the Black River.

2)     An approved Erosion Control Permit from La Crosse County Land Conservation Department and a DNR Chapter 30 Grading Permit is required before any earthwork is commenced.  Copies of these permits are to be made part of this permit file.

3)     A 50-ft vegetated buffer shall be maintained between the river and any impervious area.

4)     This permit expires July 31, 2008.

Question BLUSKE:  Site with fir trees?  Will those be removed?

Answer SCHOMBERG:  Trees will be unaffected.

Question PEDRETTI:  No fill to be brought in?

Answer SCHOMBERG:  Cut material will be used to shape areas.

 

Appearing in Opposition: 

Barb Resheske, N5317 Lake Rd, West Salem WI  54669.  Concern on area number 4 – already a low land – area is already a drainage area – also speaking for Mr. Davis – land is already swampy.  Just a concern at this point.

 

Steve Rice, 3501 State Road 35  #202, Onalaska WI  54650.  Concern for site 2, we have parcel 10 on map, concern for drainage across our land.  We have a cottage there.

 

Paul Heinz, N5351 Neshonoc Rd, West Salem WI  54669.  I have a question for the architect – any plans for expansion of area 1?                    

Answer SCHOMBERG:  No plans for that.

 

Rebuttal SCHOMBERG on drainage questions: 

Area 4, next to Davis parcel – drainage swale along road – water will be directed away from Davis parcel – on the other side of the road.  Area 2, plan should not change current drainage.

Department Recommendations:  Approve with 4 conditions:

1)     This permit is granted for 4 separate sites for filling and grading in order to create 10 new campsites that lie within the Shoreland District of Lake Neshonoc.

2)     All four sites require an approved Erosion Control Permit prior to any grading or filling.  A copy of that permit is required for this permit file.

3)     No structures are allowed within 75 feet of the ordinary high water mark of the lake.

4)     This permit expires end of August, 2009.

Question BLUSKE:  Area now grazed, will that continue?

Answer GUNDERSEN:  Yes, family looks to continue use for agricultural use, beef cattle and horses.

Question:  Bluske:  Erosion Control Permit taken out on schedule or behind?

Answer GUNDERSEN:  When we acquired Erosion Control Permit found out about 300-ft shoreland – so we are behind schedule.

Correspondence:  Letter from Carrie Olson, DNR – based on plan meets ordinance objectives.

 

Department Recommendation:  Approve with 3 conditions:

1.      This permit is granted specifically for the grading and filling of a 66-ft wide private driveway easement of which approximately 865 feet lie within the Shoreland District of Johns Coulee Creek.

2.      An approved Erosion Control Permit is required, along with all erosion control measures in place, prior to any earthwork.

3.      This permit is valid through the construction of the single-family residence to allow for proper maintenance.

Would like to make condo project Phase 3 and Phase 2 to be construction of office for approximately 35 realtors, have contacted Department of Transportation regarding access for an office building that will displace five units to accommodate parking for office.  (Scheel indicates  septic field locations and condo locations.)  Have been contacted by neighbor Bob Kaplan with concern about septics – those areas have been approved.

 

Question JUNG:  Is the intent that this is all to be one condo?  With the business interests included?

Answer SCHEEL:  May sell this office on separate parcel, will be meeting next week with business partners.  May want this as a separate parcel.

Reply JUNG:  That would need to be a certified survey map.

 

Mary Scheel, 2565 Edgewood Place, La Crosse WI  54601.  When we started this project, let me go back and give you some background.  When this property became available, at that time we were looking for office space, a place to build a new office.  Our lease was coming up and we didn’t want to renew for another ten years.  So we looked at that property; I had many meetings with Mike (Weibel) and decided we were going to do the office and keep the beauty salon and so forth.  Well, what happened in the mean time and the reason we are back here, the office we are in has been purchased, the rent has been increased and what we had negotiated for improvements this year have been taken away so now it’s back to the drawing board.  Back to what we had originally started with.  When I met with Mike we had looked at the survey map that Doug Stevermer had used or brought before this Board years ago and we really abandoned that because it doesn’t serve the needs.  I agree we don’t have a certified survey map other than what we have right here.  The office will be log cabin by the way, so it will match up with the individual log cabins (condo units) up on the hill.  So the intent is, that Stevermer map has been abandoned and we are in discussions should the whole thing remain condo, should we sell the office building and parking separately.  We can’t answer that until we speak with the gentleman who owns the company – meets with us on the 12th.

Remarks JEFF SCHEEL:  Maybe we can get together with you (Jung) and discuss these options.  We’ve talked to City Planner Larry Kirch and he has told us they have no interest.

 

Question RAUK:  Appreciate this discussion, encourage that it continue with staff, but what does this Committee need to know tonight to make a decision on this request, Mr. Bluske?

Answer BLUSKE:  (Reviews current Conditional Zoning that is in effect.)  Residential and condominium use is allowed as well as beauty salon in existing residence.  Asking tonight to add condition to allow for one 2-story office building.  That is what they are asking the Committee to do tonight so they can move forward.

 

Question RAUK:  Their full impact statement remaining of record, describing what they wish to do and when you speak you will be giving us your staff recommendations and conditions that we should add to or change?

Answer BLUSKE:  That’s correct.

 

Question MACH:  How does the office traffic affect this?

Answer J. SCHEEL:  With removal of some condos traffic counts remain the same.

NONMETALLIC MINING RECLAMATION PERMIT NO. 2008-26  Filed by Charlie Handy, La Crosse County Planner, 400 4th Street N, La Crosse WI  54601; acting on behalf of La Crosse County and the La Crosse County Facilities Department, in cooperation with the La Crosse County Economic Development Fund.  Petition to hear reclamation matters relating to the removal of borrow materials from the area known as “the Bowl” on land zoned Industrial District which falls under the regulation of Chapter 27 of the La Crosse County Code of Ordinances – Non-Metallic Mining Ordinance at the following location:  Part of the SE-SE of Section 35, T 17 N, R 6 W, described as follows:  Commencing at the SE corner of said Section 35; thence N89°27’W along the South line of the SEΌ of said Section 35 a distance of 335 feet to the point of beginning:  Thence continuing N89°27’W 960’; thence N0°07’W 312’; thence N8°23’E 383’; thence S88°16’E 104.88’; thence S48°37’E 355’; thence S77°52’E 516’; thence S4°42’E 355’ to the point of beginning.  Said parcel contains 10.62 acres.  Village of West Salem.

Question BINA:  Which fund is money for this project coming from?

Answer HANDY:  Will be money in and out of fund and that will be Facilities and Infrastructure or the Economic Development Fund.  Revenue and expenses should be close to a balance.

Correspondence:  1)  April 28, 2008 letter from Mary Jo Webster, Department of Land Conservation, letter states six conditions.  2)  Letter dated April 3, 2008 from the Village of West Salem, allowed use under Village Zoning.

 

Department Recommendation:  Approval with three conditions:

 

1.      Applicant will comply with reclamation plans approved by La Crosse County Land Conservation Department:

a.      Removal of material shall take place in 1-acre increments starting at the northwest corner – depth of material removal shall occur in three-foot deep increments to ensure that the cut slope is maintained at a 3 to 1 ratio.

b.      All areas of disturbance shall be internally drained.

c.      As the southern boundary is approached, a berm shall be constructed to maintain internal drainage.  This berm is to be stabilized immediately. 

d.      Reclamation shall be sequential – some diversions may be required above the top of slopes to prevent concentrated flow.

e.      If areas in excess of 1 acre are proposed to be open for a single project, additional information may be required.

f.       The owners shall be responsible for locating any pipe that may be within the boundary of the disturbed area.

2.      Applicant to receive approved erosion control permit from Village of West Salem.

3.   No trucks allowed past Neshonoc Road on Garland Street.
