CALL TO ORDER

The meeting was called to order at 11:39 a.m.

 

PUBLIC COMMENT

There was no public comment. 

 

CASE LOAD FILINGS/DETAILED DATA FROM OTHER COUNTIES

Jane distributed a chart listing index crimes, non-index crimes, drug crimes, and OWI crimes for the years 2005 and 2006 for various counties, and also statewide. There are still questions about the numbers and further review is warranted.

 

LIMITED RISK MANAGEMENT

Jane wanted to follow up on ways for judges to get more information prior to sentencing in misdemeanor cases.  Jane distributed a draft of the process and guidelines and these were discussed.   

 

Misdemeanor Court Report

 

Guidelines for Completion of a Proxy, LSI-R, and/or SARA

  1. Post Plea
  2. Court ordered in the following situations
    1. No agreement regarding sentencing OR;
    2. An agreement has been reached but the court is requesting more information.
  3. Justice Sanctions’ staff will complete the LSI-R and correlate with the Proxy.  After 30 days, completing the LSI-R and Proxy will be reviewed to determine if both are necessary.
  4. The following cases are recommended for review when requested:
    1. Theft
    2. Assaultive
    3. Fraud
    4. Stolen property
    5. Vandalism
    6. Sex offenses
    7. Drug possession
    8. Family offenses (domestic violence)
    1. Driving while intoxicated (4th offense)
    2. Negligent handling of burning materials
    3. Other cases as requested by the court
  1. The court will allow approximately two weeks for each LSI-R.

 

Focus groups will be developed with a list of questions, for the Public Defenders Office, District Attorney’s Office, Judges, Dept of Corrections, and the private bar, etc.  This will be put on next month’s agenda to finalize how this will be done.

 

For the next 30 days, both an LSI and proxy will be done.  After the 30 days, we will re-evaluate.
