CALL TO ORDER

The recessed meeting and Public Hearing of the Planning, Resources and Development Committee was called to order by Committee Chair George Hammes.  Let the record show that this meeting is called in full compliance with the requirements of the Wisconsin Open Meetings Law.  The procedures for tonight’s meeting are explained to those gathered.

 

SPECIAL EXCEPTION PERMIT NO. 2007-05   Warren and Renee Pickar  N6227 McKinley Valley Road  West Salem WI  54669.  Petition to perform grading work to level off a steep bank and make it a gradual grade within the Shoreland District of McKinley Valley Creek on land zoned Exclusive Agricultural District and described as:  Lot 1 of Certified Survey Map No. 14 in Volume 1.  Town of Hamilton.

 

Appearing in favor: 

Warren Pickar  N6227 McKinley Valley Road  West Salem WI  54669.  Distributes aerial photo.  Area entails about 22,000 square feet or less than ½ acre.  Total drainage is less than 1 acre.  It has a 10-ft drop.  It’s within about 75 feet of the road and my concern is liability and safety of those who are entering my property.  There are a couple of depressions from old building foundations settling that I’d like to level off, seed down and get back to a natural habitat.

 

Question BINA:  It looks like the rest of the area is seeded over with trees.

Answer PICKAR:  You can see the ledge I’ve indicated (refers to overhead).  It runs for about 75 feet.  Don’t plan on disturbing the pointed area, but want to push that and level it toward the flatter area, flatten it out and move as little dirt as possible.  I’ve been trying to keep the noxious weeds down and it’s hard to get around there to mow or spray.

 

Question BLUSKE:  Will you sell the parcel?

Answer PICKAR:  No sir, absolutely not.

 

Blaine Lee  N6397 Bergen Coulee Road  West Salem (Town Supervisor).  I viewed the property and ask the Board to approve.  It will improve drainage from the road.  It will also make it safer.

 

Question BLUSKE:  Has the Town Board ever taken action on this?

Answer LEE:  No.  It’s our opinion it would be a good project.

 

Opposition:   None.

 

Correspondence:  None.

 

Department Recommendation: 

    

Approval subject to 5 conditions:

1)     This permit is granted specifically for grading a steep stream bank between the road

right-of-way and the creek with an estimated area of disturbance around 22,000 square feet.

2)     No additional materials are allowed to be brought to the site.

3)     This permit is only valid with an Erosion Control Permit from La Crosse County Land Conservation Department before any grading takes place.

4)     Any employee of this Department or that from the Department of Land Conservation shall be allowed access to this project site for checking permit compliance.

5)     This permit expires August 31, 2007.

 

Motion by Meyer/Hanson to approve with conditions as recommended.

ZONING PETITION NO. 1742   David A. and Anne Paape  W6668 Long Coulee Court  Holmen WI  54636.  Petition to rezone from Exclusive Agricultural District to Agricultural District “A” a 22.76 acre parcel in order to create two single family residential lots on land described as:  Part of the SE-NE of Section 20, T 18 N, R 7 W described in tax parcel No. 8-243-0; together with a 66-foot access easement.  Town of Holland.

 

Appearing in favor:

David A. Paape  W6668 Long Coulee Court  Holmen WI  54636.  We would like a 10-acre building site along the road front (refers to overhead).  In the Town of Holland we need 10 acres for a building site.

 

Question BLUSKE:  There’s an old quarry road to the top of the hill through the property.  There’s an abandoned quarry and at one time was subject to a manufacturing assessment.  What are your plans for this parcel (refers to overhead) and would this 10-acre lot have any access off that (quarry road), because that is steep.

Answer PAAPE:  It is steep back there.

Question BLUSKE:  What are your intentions for that remaining piece?
Answer PAAPE:  To add to our property.  We own the adjoining 50 acres.  The only possibility is where it says Michels and Kuber (overhead), they have asked if there was a way he could get an acre or two if it is rezoned to add a buffer to his property.  My feelings are mixed on that.  We have a network of trails in that and that’s what we want to keep.  The quarry road is gated at County Road V.  Where our property starts, we have an easement for that to access the back side of our property for recreation, hunting, things like that.  There’s no quarry operation and we signed a statement saying we wouldn’t have a quarry operation. 

Opposition:  None.

 

Correspondence:  Town of Holland dated March 14, 2007 (fax date), received May 15, 2007.  Board action:  No objection at this time; Hammes cautioned the Town has a 20 percent grade limitation and a 10-acre minimum for a buildable lot.

 

Department Recommendation:  Parcel is consistent with the new Town plan.  Soils are not conducive to Exclusive Ag use.  Recommend approval as Conditional Zoning subject to the recording of deed restrictions indicating only one additional buildable site of 10 acres on this parcel. 

 

Motion Hanson/Meyer to approve with conditions.  Motion carried unanimously.

 

SPECIAL EXCEPTION PERMIT NO. 2007-06   The Potato King Inc.  N1078 Justin Road  La Crosse WI  54601.  Petition to perform excavation work for the removal of borrow materials to be removed from the site and do final grading for additional parking on lands that fall in the Shoreland District of Mormon Creek and zoned Agricultural District “A” on lands described as:  Part of the N½-SE of Section 23, T 15 N, R 7 W described in tax parcel No. 11-1789-0.  Town of Shelby.

 

Appearing in favor:  Keith Herlitzke  o/b/o of the Potato King Inc.  N1078 Justin Road  La Crosse WI  54601.  This is a follow-up to our request about a month ago.  We’re removing fill for retention ponds.  There will be a small island, roughly 2000 acres (cubic yards?) of fill left in the middle.  We either need to shape around this island or remove it now so we have drainage to the retaining pond in the back.  It would be easiest to get it done now and cleaned up. 

 

Question BLUSKE:  Who do you have lined up to do this and how are you going to get rid of it (fill)?  Do you have one contractor, are you going to let anybody in there?
Answer HERLITZKE:  Right now there’s a building site across from Charlie’s in the back there.  That’s where they’re hauling fill now from the retention ponds.  They said they’d take all the fill we have.  I hope they do – they’re paying for the trucking and hopefully they will use it all, but if not, I’ve contacted several contractors and told them they could have it for free – they just need to remove it.  There won’t be any dirt transferred to the road.  They need to go through a mile of parking lot before they get to the road.

 

Question BLUSKE:  After the last public hearing we had, there was a representative from the City of La Crosse who said they had been approached to annex this.  Are you planning to annex this for future development?  What are your plans once the fill is gone?

Answer HERLITZKE:  I looked to the City for annexation for sewer and water, and they want too much.  The development is for parking.  You see how big we’ve grown – it’s not going anywhere.  It’s all staying for Potato King. 

 

Opposition:  None.

 

Correspondence:  A telephone call taken by Mike Weibel on May 30, 2007:  “I received a telephone call from Town of Shelby Administrator Jeff Brudos.  Mr. Brudos stated that the Town of Shelby Board had considered the Special Exception Application 2007-07 by Potato King and recommends approval.”  This was signed by Mike Weibel.

 

Department Recommendation:   Approval recommended - subject to the following 6 conditions:

1)     This permit is granted specifically for performing excavation work to remove

stockpiled borrow materials and to do final grading work for additional parking on     lands that fall within the Shoreland District of Mormon Creek.

2)     An approved Erosion Control Permit is required for this work before any materials

      leave the site.

3)     There will be absolutely no tracking or spillage of materials from truck hauling the 

      material away that may end up in the creek.

4)     This permit expires the end of August 2008.

5)     Any employee of this Department or from the Department of Land Conservation shall be allowed access to this project site for checking permit compliance.

6)     This permit is nontransferable.

 

Motion by Kapanke/Hanson.  Motion carried unanimously.

 

CONDITIONAL USE PERMIT NO. 749   The Potato King Inc.  N1078 Justin Road  La Crosse WI  54601.  Petition to remove approximately 2,200 to 2,500 cubic yards of borrow materials from a site zoned Agricultural District “A” with a Conditional Use Permit for commercial produce expansion, on land described as:  Part of the N½-SE of Section 23, T 15 N, R 7 W described in tax parcel No. 11-1789-0.  Town of Shelby.

Remark BLUSKE:  This permit explains how you will remove the fill, hours of operation and these types of activities.  If you don’t have them, the Committee sets them. 

Reply HERLITZKE:  It will be during daylight hours, normal business hours.

 

Question BLUSKE:  Will it be one hauler?  Timeframe?  Will it be done by this year?

Answer HERLITZKE:  I’m hoping the person from the earlier permit will take it all this year.  If they don’t, then whoever wants it.  I don’t want the removal expenses and hauling it to somewhere it’s not needed.  August of next year would be fine. 

 

Question HAMMES:  August of 2008?

Answer HERLITZKE:  Yes.  I’m hoping to get rid of it all this year; in the next month or two if this proceeds as planned.

 

Question BLUSKE:  Everything there is clean soil?  There’s no fill from torn down buildings?

Answer HERLITZKE:  No.  It’s all sand and clay.

 

Question RAUK:  To clarify, when you say daylight hours do you mean 5 or 7 days a week?

Answer HERLITZKE:  Most contractors only work 5 days a week, maybe Saturday mornings.

Opposition:  None.

 

Correspondence:  Town of Shelby, same phone call indicated they approved the Conditional Use Permit, but they had no conditions.

 

Department Recommendation:   Recommend approval subject to 6 conditions:

1)     Permit granted to remove approximately 2500 cubic yards of stockpiled borrow 

material.

2)     Potato King is responsible for compliance with Chapter 21 of the County Code of

Ordinances for an approved Erosion Control Plan.  No borrow can be removed until

a plan has been approved.

          3)  Absolutely no tracking of materials on roadway.  No materials my be removed on

                  rainy days.

4)     Hours of operation:  8 am to 5 pm, Monday through Friday.  No weekends or

      holidays.

5)     Permit expires August 31, 2008.

6)     Permit is non-transferable.

 

Remark HAMMES:  You might want to add a seventh.  When they’re done removing the fill have them notify Zoning.

 

Motion Meyer/Hanson to approve with conditions; adding a 7th condition stating that upon completion of borrow project, Potato King Inc. is responsible to contact the La Crosse County Zoning Department to notify them of completion.  Motion carried unanimously. 

 

CONDITIONAL USE PERMIT NO. 750   Jeffrey A. and Nick Hansen  N8381 US Highway 53  Holmen WI  54636.  Petition to modify existing Conditional Use Permit No. 608 to enlarge the parking area, to show a total of 40 vehicles which includes 30 cars/trucks and up to 10 recreational vehicles such as boats, ATV’s and motorcycles on land zoned Transitional Agricultural and described as:  Lot 1 of Certified Survey Map No. 85 in Volume 5.  Town of Holland.

 

Appearing in favor:  Jeffrey Hansen  N8381 US Highway 53  Holmen WI  54636.  Want to extend my lot so I can go from 10 cars to 40 cars.  Size would be 40-ft x 100-ft.

 

Remark BLUSKE:  Use the laser pen to mark on the overhead where you want to park cars. (Hansen marks on overhead). 

 

Remark HANSEN:  I’d eventually black-top it.

 

Question BLUSKE:  Does existing CUP allow ATV’s, UTV’s jet-skis, trailers; or are you asking to expand into that?

Answer HANSEN:  I wanted the option of selling a boat trade-in; up to 5 vehicles, boats, ATV’s.  If somebody trades in an ATV, I want to be able to sell it there.

 

Question BLUSKE:  When you talked to the Department you were looking at 40 vehicles – 30 cars and up to 10 other types of vehicles?

Answer HANSEN:  Thirty vehicles to sell, ten to work on and five jet-skis, boats…up to that.

Question BLUSKE:  Do you need a separate dealer’s license for those vehicles? 

Answer HANSEN:  Not for motorcycles, but jet-skis and boats you need DNR approval.

 

Question RAUK:  I’m confused by the numbers.  In your request you ask for not more than 5 non-auto vehicles?

Answer HANSEN:  Yes – boats, ATV’s, whatever.

Question RAUK:  On the permit paper it says up to 10.

Answer HANSEN:  It’s  a total of 40 cars – 10 to work on and 30 for sale, then 5 for boats or whatever.

Question RAUK:  So with total vehicles, we’re looking at 45?

Answer HANSEN:  Yes, but no more than 5.  I just want to be able to take them (non-autos) as a trade-in.

Question BLUSKE:  45 is the number.

Answer HANSEN:  Yes.

Question BLUSKE:  Let’s lump them together and call them recreational vehicles.  And only 30 vehicles offered for sale, and another 10 you’re working on.

Answer HANSEN:  Yes.

 

Question RAUK:  Will that area hold that many vehicles?

Answer HANSEN:  Yes.  It’ll be tight.  Chances are I won’t have 10 to work on, usually only 2 or 3.  I can fit 30 easily for selling.

Correspondence:  Town of Holland, action taken April 11, 2007.  No objection by Board at this time to a CUP amendment.

 

Department Recommendations:  Approve with 13 conditions:

 

1)     This Conditional Use Permit replaces Conditional Use Permit No. 608 in its entirety.

2)     This Permit allows for the operation of an automobile repair and body shop along with an automobile, boat and other recreational vehicle sales establishment.  This permit will allow a maximum of 45 vehicles, where only 5 could be identified as: boats, ATVs, UTVs, jet skis, trailers, motorcycles, dirt bikes; and 10 vehicles in repair.  This will not include the owners’ personal vehicles.

3)     This permit will only allow 30 vehicles (as identified in condition #2) to be offered for sale at any given time.

4)     Vehicles to be sold must be kept neat and orderly and can only be stored in designated area, shown on map correlating with this Conditional Use Permit.

5)     No accumulation of junk or salvage material as identified in Section 17.15 of La Crosse County Zoning Ordinance.

6)      No vehicles (as identified in #2, above) can be kept on this property for a time period  

       exceeding 6 months.  Excludes owners’ personal vehicles.

7)      A valid dealer’s license must be kept at all times.

8)      Permit is good for Jeff Hansen and his son, Nick Hansen, but is otherwise    

      nontransferable.

9)       Hours of operation: 8 am to 5 pm, Monday through Saturday.  No Sundays or

  holidays.

10)   Signs permitted:

- One 6-ft x 8-ft unlighted commander board – must be approved by Wisconsin  

   Department of Transportation.

- One 4-ft x 12-ft lighted sign on building

- No other signs allowed

     11)  A maximum of 10 vehicles needing repair or body work are allowed on the  

 property at any one time.

12)  Parcel must comply with the Town of Holland commercial site plan ordinance.

13)  This permit is non-transferable.

 

Question MEYER:  In the write-up he’s talking about increasing size of the sign, now there’s 2 signs?  From 4-ft x 6-ft to 6-ft x 8-ft?

Answer BLUSKE:  We’ll allow 2 signs, enlarging one sign to 4-ft x 12-ft.

 

Question MEYER:  The one is going from 4-ft x 6-ft to 6-ft x 8-ft?

Answer BLUSKE:  Yes.


Motion by Bina/Meyer to approve with recommendations.

 

Question RAUK:  Don’t we normally put in a condition about number of employees?

Answer BLUSKE:  We have in the past.  It hasn’t been an issue here.

 

Question RAUK:  You mention him and his son and vehicle counts.  I wonder if the son’s vehicles are exempt from the vehicle count.

Answer BLUSKE:  Any of their personal vehicles.  Mr. Hansen’s concern was the non-transferable portion.  His son will be his successor and he wanted his name on the permit.

CONDITIONAL USE PERMIT NO. 751  Richard S. and Margaret Johnson  W5716 Stumlin Road  Holmen WI  54636.  Petition to operate an after-the-fact terrazzo flooring business with contractors storage yard on a 20.00-acre parcel zoned Agricultural District “A” and described as:  The E½-NE of Section 10, T 18 N, R 7 W together with an easement access.  Town of Farmington.

 

Appearing in favor:  Peggy Johnson  W5716 Stumlin Road  Holmen WI  54636.  I didn’t know we needed a Conditional Use Permit.  Have been running terrazzo flooring business.  He works out of town and it’s for his equipment.  That’s why I’m here – he’s out of town.

 

Question BLUSKE:  Tell us what your site looks like and where the equipment is stored.

Answer JOHNSON:  (Referring to overhead)  The house is here, this is the storage shed – Chad, what size is it?
Answer VANDENLANGENBERG:  We listed it as 20-ft x 30-ft.

 

Question BLUSKE:  Is there any demolition?  Any materials brought back to site?  You’re not buying anything?

Answer JOHNSON:  No.

 

Question BLUSKE:  Any harmful chemicals we need to know about?

Answer JOHNSON:  No.  Everything is delivered to the site where they work.  We get no deliveries. 

 

Question BLUSKE:  Do employees keep cars there?
Answer JOHNSON:  Yes – they would be in our driveway.

Question BLUSKE:  Can you show the Committee where they are parked?

Answer JOHNSON:  (Referring to overhead)  The shed’s here and the cars are by the shed and here.  There’s only 3 employees.

 

Question BLUSKE:  One of the Committee members questioned where the road ends, because it turns to sand.

Answer JOHNSON:  You come off Baker Road – it turns into Stumlin Road for probably 100 feet.  The rest is owned by us and Coopers.  We maintain it ourselves.

Question BINA:  Does the Town plow that?

Answer JOHNSON:  Only the 100 feet.

 

Question RAUK:  Your mailboxes are at the end of the road?

Answer JOHNSON:  They were on Baker Road.  They moved them back and we had to change all our addresses to Stumlin Road.

 

Question BLUSKE:  What happens if you expand and need more equipment than you have now?

Answer JOHNSON:  We’re not planning on that.  He’s been in business 11 years.

 

Question BLUSKE:  Have you met with Town of Farmington?

Answer JOHNSON:  No, was I supposed to?

Answer BLUSKE:  Yes.

 

Remark HAMMES:  They meet next Tuesday.  Mr. Hesse is the Chairman.  Give him a call.  Call Chad tomorrow.  He’ll give you Mike’s number.

Question JOHNSON:  I forgot to do that.  Sorry.  Do I need to come back?

Answer HAMMES:  No.

 

Opposition:  None.

 

Department Recommendations:  Approve with 7 conditions:

1)     Permit allowed for Johnson Terrazzo Inc. to operate a terrazzo flooring business only.

2)     Permit allows business equipment to be stored in an existing 20-ft x 30-ft outbuilding.

3)     Permit allows one enclosed trailer to be used for the business to be stored in the existing outbuilding when not on any jobsite.

4)     A commercial dumpster must be utilized for disposal of any waste materials generated by the business and disposed of from this site.

5)     This permit allows for a maximum of 3 employees other than Richard & Margaret Johnson.

6)     Permit is non-transferable.

7)     No signage allowed anywhere.

 

Motion by Meyer/Hanson to approve with recommendations.

Carried unanimously.

 

REVOCATION OF CONDITIONAL USE PERMIT NO. 714   Jeff Bluske, Director, and Chad Vandenlangenberg, GIS Specialist/Enforcement Officer, Zoning, Planning and Land Information Department, 400 4th Street North – Room 3170, La Crosse WI  54601.  Petition the County Board to revoke Conditional Use Permit No. 714 issued to Daniel Marini, also known as Complete Salvage Service Inc., W3697 County Road Q, Mindoro, WI  54644, acting on behalf of Kelly Johnson, N9274 State Road 108, Mindoro, WI  54644, for failure to comply with a majority of the conditions placed on their junk and salvage business, more specifically an automobile and scrap metal business with parts sales in a fenced in area containing 18.3 acres together with a 66-foot access easement, on land zoned Industrial District and described as:  The North 800 feet of the East 1000 feet of the SW-NW of Section 10, T 18 N, R 6 W.  Town of Farmington.

 

Testimony by Chad Vandenlangenberg

HAMMES:  Raise your right hand.  Do you solemnly swear that the testimony you are about to give is true and correct to the best of your knowledge and belief under the pain and penalty of perjury?

VANDENLANGENBERG:  I do.

HAMMES:  State your name and address.

VANDENLANGENBERG:  Chad Vandenlangenberg, Land Use Specialist, La Crosse County, 400 4th Street North, La Crosse.  This property has a detailed history.  I drafted a revocation packet.  This dates back to about 1993 when the original rezone occurred.  I started working with Mr. Marini and Mr. Johnson about 6 months after starting work with La Crosse County.  There have been numerous complaints about his salvage operation throughout the years; we’ve issued numerous citations and they’ve been found guilty on numerous occasions.  After a lengthy clean-up process, Mr. Marini filed for a Conditional Use Permit under the newer zoning ordinance – it used to be a Special Exception Permit.  That CUP was approved with 12 conditions on April 13, 2006.  I’ll go through the conditions for the record.

1)     Permit granted to operate an automobile and scrap metal business with parts sales in a completely fenced in area with a 66-foot access road.

2)     The North and East sides shall be fenced with a solid, minimum 6-ft high privacy fence except for locked gate entry; the South and West sides shall be fenced with 10-ft high wire net fence.

3)     A lockable gate shall also be installed at the entrance of the 66-ft road on County Road Q.

Testimony CHAD VANDENLANGENBERG (CV):  None of the fencing requirements listed on this Conditional Use Permit were installed.

 

4)     The 66-ft access shall be graveled wide enough to allow for vehicles going in and out.       

Testimony CV:  This access road is still sand and has not been improved.

 

5)     Employees:  One office manager, three combination yard workers and tow drivers.

Testimony CV:  Mr. Marini never submitted any detailed plans of who was employed with his business.

 

6)  All vehicles shall be processed according to the business plan submitted March 10, 

     2006, which is part of these conditions.

Testimony CV:  There hasn’t been any processing on-site in the past year.

 

7)  The two proposed buildings, 60-ft x 120-ft and 30-ft x 120-ft, shall have state 

approved plans along with approved and installed drain field and gray water tanks 

and office.

Testimony CV:  The Zoning Department has not issued any permits for these buildings.  They have not been constructed to date.

 

8)     The existing mobile home will be used as the office where all records are kept and transactions handled for the used car area

Testimony CV:  The mobile home is currently being occupied as a residential structure which constitutes a violation of the La Crosse County Zoning Ordinance.  The mobile home can only be used as a residential structure by a watchman of the business.  There is no business – he has no license from the DOT or the County.  As soon as this is revoked, I’ll ask that the mobile home be removed or the property get rezoned to a Residential District to allow it. 

 

9)     Two federal permits are required along with construction completed before commencement of any yard activities; storm water pollution prevention plan and a storm water discharge permit.

Testimony CV:  Neither of these permits have been obtained.  I did check with the DNR.

 

10)  The following State of Wisconsin permits are required and will not be signed until all yard requirements, including fencing, are in place:

1.      Wisconsin Seller’s Permit – to sell parts

2.      Wisconsin Refrigeration Recovery Permit

3.      Wisconsin Auto Dealer’s License – to sell used cars

4.      Wisconsin DOT Salvage License – Category 1

5.      Wisconsin Hazardous Waste Transportation License;

            All for this location at W3697 County Road Q.

Testimony CV:  Mr. Marini currently does not have any of these licenses.  He did have a Category 4 Salvage License, but according to the Madison DOT, that expired March 31 of this year.


 

 

11)  All items of personal property shall be listed each year and given to the local assessor.

Testimony CV:  I’m not sure if that’s been done; I wasn’t concerned about that because there was no business on that property.

12)  The local fire department shall be notified of all flammable materials and quantities.

Testimony CV:  I don’t believe that’s been done either, although at my last check of the site there weren’t any fluids out there.

 

Testimony CV:  Our intent with this CUP and all of the conditions was to give Mr. Marini the opportunity to become compliant and to start a justifiable business from this property.  All indications at this point tell me it’s not going to happen.  None of the buildings have been erected, the fence hasn’t been erected.  At this point it’s best that we revoke this.  He can still have his Industrial Zoning if he wants, and if he wants to resubmit a CUP at a later date to operate from this yard we can take it up at that point.  Any questions?

 

Question KAPANKE:  Can you ensure all of this is factual and correct?

Answer CV:  Yes.  You can look through the files.

 

Question KAPANKE:  Even though we revoke this, what will happen with the items out there?

Answer CV:  During my last check I didn’t see a lot of junk and salvage material.  A lot was farm machinery.


Question MEYER:  What about the boat?

Answer VANDENLANGENBERG:  I don’t remember seeing a boat.

Remark HANSON:  The boat was mixed in with some farm machinery.  It’s been cleaned up quite a bit.  There were some cars and buses – the back wood lot was full of items, but now it’s gone.

Remark CV:  My interpretation of the Zoning Ordinance…if he had a boat there that was for person use or recreational use, that would be allowed.  It would still have to be operational.  There’s still a couple of mobile homes right on County Road Q – those are the old mobile homes Holmen School District was using.  He (Marini) bought them.  My last letter to them dated April 17 notifying them of this revocation hearing – I believe I mentioned they had to get rid of those.

 

HAMMES:  Is Kelly Johnson here?  Mr. Marini?  Does anyone else wish to speak regarding this revocation hearing (3 calls)?

 

Motion Hanson/Meyer to revoke Conditional Use Permit #714.

 

Question BINA:  If this is revoked, would the status of the land stay the same?

Answer BLUSKE:  Yes.  It’s zoned Industrial.  We’ve been talking with Kelly Johnson who owns the land and always has agreed to sell to Mr. Marini, but has never done that.  We’ll be talking to him, not Dan, to clean up the property.  If his intention is to keep the mobile home, they’ll have to rezone it because it can’t stay in an Industrial zone.  We still have compliance issues.

 

Motion to revoke Conditional Use Permit #714 carried unanimously.
