Committee Chair George Hammes called the meeting to order at 4:00 p.m.
APPROVAL OF MINUTES
MOTION by Hanson/Keil to approve minutes of April 30, 2007. Motion carried unanimously.

REVIEW BEAVER BUILDERS EROSION CONTROL PLAN
Mary Jo Webster reviewed. Copies of the letter, dated April 9, 2007, regarding “Notice of Non-compliance with Erosion Control Permit #1173-06 were sent with the agenda. A memo from Ms. Webster to the committee, dated May 30, 2007, indicated the requirements set forth in the non-compliance letter have all been met.
With the additional grading performed outside of the original plan, the overall disturbance is now at about 6-7 acres. The original erosion control plan was under the 5-acre threshold disturbance area and did not need committee approval. Citations were issued to the engineer and excavator, reasons being that both were at the pre-construction conference during which time the approved site plan was reviewed including the limits of disturbance. Committee members questioned why this occurred. Responding were Dick Berg, as the engineer, and Greg Stellrecht, as the owner, noting oversight; their focus was on the DNR approval process which took almost 2 years, and they forgot to bring the revised plan back to the County. Mary Jo indicated that they did review the approved site plan at the on-site conference.
Mary Jo noted the committee needs to approve the erosion control plan for the grading project for Beaver Builders Properties. It meets the requirements set forth in Chapter 21, but it requires a final inspection, including the owner or representative and Land Conservation staff, at the end of the project, and the permittee is also required to provide the Land Conservation Dept. with as-built plans for the road and designed ditches.
MOTION by Rauk/Keil to approve the erosion control plan for Beaver Builders Properties including the inspection and as-built plans as required and as stated above. Motion carried unanimously.
CONDITIONAL USE PERMIT NO. 748, JOHN AND DAWN MACEWEN, TOWN OF MEDARY
Jeff Bluske reviewed. The letter from the Town of Medary was received on May 10, 2007, after the committee’s public hearing held on April 30, 2007. The Town approved the conditional use permit with

the same conditions as the committee approved at the public hearing. MOTION by Bina/Meyer to approve Permit No. 748 for John and Dawn MacEwen, Town of Medary, including the same conditions as approved at the April 30, 2007 public hearing, those being:
1. Allow two existing signs advertising business to remain: 4-ft x 6 ft and 4.5 ft x 5.5 ft.
2. Allow permit to be transferable as the property is currently for sale.
3. New hours of operation:
September – December: Monday through Friday 10 am to 8 pm
Saturday 10 am to 6 pm
Sunday 11 am to 5 pm
January – October: Monday through Saturday 10 am to 6 pm
Sunday 11 am to 5 pm
4. Change legal description to read: Certified Survey Map #80, Volume 12, Lot 2.
Town of Medary.
5. The green house must be removed under terms of enforcement letter dated
April 11, 2007.
Motion carried unanimously.
RESOLUTION RE APPROVAL OF THE LAND USE ELEMENT FOR THE UPDATE OF THE LA CROSSE COUNTY COMPREHENSIVE PLAN
Charlie distributed copies of the resolution and briefly reviewed. MOTION by Rauk/Meyer to approve the resolution. Discussion followed. Committee Chairman Hammes expressed concern that limiting the development acreage could be cause for legal action; let the developers go where they want to be and not force them to go elsewhere. Charlie said the thresholds are meant to assist the towns in La Crosse County in having equal opportunity for development; if a town wants to increase over the threshold amount, then they need to get their plan amended within the County plan and all the towns are also notified of this request. Motion carried on 6 to 1 vote; Hammes-no.
REPORT ON TRANSFER OF CONDITIONAL USE PERMIT NO. 279 FROM DENNIS PIERCE TO KEVIN NAAS, TOWN OF HOLLAND
Jeff noted the Conditional Use Permit no. 279 was approved in 1993, without the condition of non-transferable. The permit was for a 45’ x 80’ storage building for a trucking business and storage of trucks. The property was recently sold and the new owner needs same storage for a construction business. The Zoning, Development and Land Information Department has approved a transfer of Conditional Use Permit no. 279 from Dennis Pierce to Kevin Naas, W7943 Old Highway 93, Town of Holland. Noted that in order to not allow a transfer, it would require another public hearing. Informational.
APPROVE WITHDRAWAL OF CONDITIONAL USE PERMIT APPLICATION NO. 761, ELEANOR HERRICK, TOWN OF HOLLAND
Jeff noted the request was to board, breed and train dogs located on property in the Town of Holland. At the time of the public hearing, staff recommendation was to deny; it was also referred for 30 days. To-date there have been two meeting referrals. Letters were sent to Ms. Herrick noting her original request will be withdrawn due to time limit requirements; no response received. MOTION by Hanson/Keil to withdraw Conditional Use Permit Application No. 761 for Eleanor Herrick, Town of Holland. Committee Chair Hammes, as the Town of Holland Chair, thought the animals have since been removed. Motion carried unanimously.

APPROVE EXTENSION OF ZONING PETITION APPLICATION NO. 1722, STRUPP TRUCKING, TOWN OF MEDARY
Jeff noted Zoning Petition Application No. 722 for Strupp Trucking, Town of Medary, was heard in July, 2006. as an after-the-fact as it was originally a residential house used for commercial use. In May, 2007, they were notified that they were in violation by running a cement trucking business on that parcel; at this time they indicated they are in the midst of purchasing additional land. Jeff noted another adjacent landowner is coming before the committee at next month’s meeting; Strupp has indicated they want to purchase this parcel as well. Jeff requested referral of the matter to the next committee meeting. MOTION by Bina/Meyer to approve referral to the next committee meeting the extension of Zoning Petition Application No. 1722, Strupp Trucking, Town of Medary. Motion carried unanimously.
DISCUSS CURRENT ORDINANCE TO TERMINATE OLD CUP PERMITS – PUBLIC HEARINGS
Copies of two-page, newly created “Petition to Terminate Conditional Use Permits” were distributed. Chad Vandenlangenberg as the new GIS Specialist/Enforcement staff person will be recommending termination of old conditional use permits at future public hearings. The first one is coming up at tonight’s public hearing. Could expect up to 2-10 per month. Basis for termination as listed on the new form:
Chad also noted a detailed report will also accompany the 2-page form and distributed to committee members prior to the public hearing. MOTION by Meyer/Hanson to approve the use of the new forms - “Petition to Terminate Conditional Use Permits”. Motion carried unanimously.
