CALL TO ORDER/ROLL CALL

Committee Vice Chair J. Terry Hanson called the meeting to order at 4:30 p.m.

 

APPROVAL OF MINUTES

MOTION by Meyer/Rauk to approve minutes of April 2, 2007.  Motion carried unanimously; Hammes and Hansen excused.

 

PUBLIC COMMENT

None requested.

 

CONDITIONAL USE PERMIT NO. 747, JEFFREY AND AMY MIDTLIEN, TOWN OF WASHINGTON

Jeff Bluske reviewed noting at the April 2, 2007 public hearing, the committee had approved conditional use permit no. 747, that also included 8 conditions, for Jeffrey and Amy Midtlien to allow family-run welding repair shop business on land zoned Exclusive Agricultural District in Town of Washington.  This was deferred because there was no correspondence from the town.  Since, a letter was received on April 9, 2007, from the Town of Washington that concurs with the County zoning decision.  This now needs re-approval based on town approval.  MOTION by Rauk/Keil to approve conditional use permit no. 747 for Jeffrey and Amy Midtlien, Town of Washington, including the following 8 conditions:

  1. Hours of operation shall be 7:00 a.m. to 9:00 p.m., Monday through Saturday.

  2. No employees are authorized except for members of the Jeff Midtlien family.

  3. No outside storage of parts or materials associated with the welding business is authorized.

  4. No on-site retail sales are authorized.

  5. Applicant shall notify the appropriate fire department of flammables located on the site related to this business.
  6. This permit is not transferable.
  7. A 30’ x 40’ detached accessory building is authorized for this activity.  A zoning/occupancy permit is required for this building.
  8. Applicant shall comply with welding industry safety standards.     

Motion carried unanimously; Hammes excused.

 

CONDITIONAL USE PERMIT NO. 745, JOHN AND BARBARA SCHALLER, TOWN OF ONALASKA

Jeff reviewed noting at the April 2, 2007 public hearing, the committee had approved conditional use permit no. 745 for John P. and Barbara K. Schaller to construct a 44’ x 360’ heifer raising barn for an expanded livestock facility for herd expansion to 895 animal units total on land zoned Transitional Agricultural District in the Town of Onalaska.  This was held over as the Town had not met.  Stan Hauser, Chairman of the Town of Onalaska, was present and reviewed town action.  It was approved by the Town Planning Commission and then went before the Town Board; two members abstained and two voted in favor; vote was 2-2, so there is no recommendation from the Town of Onalaska.  Supervisor Burke who represents that area said she has known the Schaller family for many years; she also received some letters in objection; the only concern she has is that the Schaller’s get all the necessary permits.  Jeff noted the DNR will get involved following County Board action.  Gregg Stangl (Land Conservation) also noted the Schaller’s have a complete application per ATCP51.  MOTION by Bina/Keil to approve conditional use permit no. 745 for John P. and Barbara K. Schaller, Town of Onalaska.

Motion carried unanimously; Hammes excused.    

 

RESOLUTION RE ADOPTION OF AMENDMENTS TO LA CROSSE COUNTY DEVELOPMENT PLAN 2020 FOR THE TOWN OF HAMILTON

Charlie noted all 3 resolutions before the committee today regarding the town plan amendments have some minor revisions from the first resolution that was presented at the March 5, 2007 meeting.  An additional Whereas paragraph was added:  Whereas, because the La Crosse County Board has a regional viewpoint in land use decisions there is likelihood that both the County and the town will not agree on all points in these plans, as amended, but the general goals, implementation tools, and recommended land use types as delineated on the recommended land use type map are agreed to with this resolution.  Attached to each resolution is “Development Review Thresholds” for each Town and if they exceed the noted thresholds, then it requires approval of town plan amendment.

 

For the Town of Hamilton, the amendment is for one land use change which is minor revision.  MOTION by Rauk/Meyer to approve the resolution which amends the La Crosse County Development Plan 2020 to include the Town of Hamilton amendment as presented.  Motion carried unanimously; Hammes excused.

 

RESOLUTION RE ADOPTION OF AMENDMENTS TO LA CROSSE COUNTY DEVELOPMENT PLAN 2020 FOR THE TOWN OF ONALASKA

Charlie noted this as a complete town amendment as approved by the Town of Onalaska in June 2006.  MOTION by Bina/Keil to approve the resolution which amends the La Crosse County Development Plan 2020 to include the Town of Onalaska amendment as presented.  Motion carried unanimously; Hammes excused.

 

RESOLUTION RE ADOPTION OF AMENDMENTS TO LA CROSSE COUNTY DEVELOPMENT PLAN 2020 FOR THE TOWN OF HOLLAND

Charlie noted this as a complete town amendment as approved by the Town of Holland.  MOTION by Keil/Rauk to approve the resolution which amends the La Crosse County Development Plan 2020 to include the Town of Holland amendment as presented.  Discussion followed.  Bina noted concern of citizen opposition and if the new Town Board had acted on this amendment.  Charlie noted the only difference is the threshold that is in excess of 140 acres for non-residential.  Also noted that the Village of Holmen is planning to annex the area that is in question.  Bina questioned why approve it now when the Village will be annexing it.  Motion carried on 5 to 1 vote; Bina-no; Hammes excused.  

 

ORDINANCE TO AMEND CHAPTER 27 ENTITLED “NONMETALLIC MINING RECLAMATION” OF THE GENERAL CODE OF LA CROSSE COUNTY, WISCONSIN

Gregg Stangl reviewed noting the DNR made changes to NR 135, Wis. Adm. Code which implements state law and requires that counties administer a nonmetallic mining reclamation program to ensure statewide consistency in reclamation.  This ordinance will amend sections in Chapter 27 entitled “Nonmetallic Mining Reclamation” in accordance with the new NR 135.  Most of the changes relate to housekeeping, streamlining administrative procedures, increase fees, etc.  Copy of the complete ordinance will be in the May County Board packet for review.  MOTION by Meyer/Bina to approve the ordinance amendment, as presented, to Chapter 27, Nonmetallic Mining Reclamation.  Motion carried unanimously; Hammes excused.

 

NOTICE OF NATIONAL WATERSHED CONFERENCE

Gregg noted the National Watershed Conference will be held in La Crosse on May 20-23.  The theme is “Total Watershed Awareness – Extending the Legacy”.  Federal, state and local officials are expected to be in attendance.  He noted La Crosse County has 2 watersheds though other counties, such as Vernon, have many more.  Gregg would have liked to attend but no funds for such in his 2007 budget.  Supervisors Bina and Hanson also noted they would have liked to attended a portion of the event.
