The La Crosse County Board of Supervisors Monthly Meeting was held on September 20, 2007 in the Administrative Center, Room B410.  Chair Doyle called the meeting to order at 6:00 p.m.  The County Clerk, Marion I. Naegle, took attendance.  All supervisors were present except as noted:

·          SEBRANEK – Amtrack goes to Wisconsin Dells and is cheap fare for anyone interested for the Wisconsin County Association (WCA) Conference.

·          BINA – Has raffle tickets for sale for the Resource and Development State Organization for Conservation.

·          FREEDLAND –Announced the upcoming presentation on Sustainability, the New Economy and the Eco-Municipality Movement, at the University of Wisconsin at La Crosse (UWL) on Monday October 8th by Fred Schnook.

·          BURKE – Five supervisors attended an impressive presentation at the Evidence Based Practice Conference.  Supervisor Burke is hoping to have the full Board hear the presentation soon.

·          PROPERTY TAX SUMMARY:  The County portion of La Crosse County property taxes are one of the lowest in the State despite a lower than average tax base.

·          LAW ENFORCEMENT CENTER ADDITION:  No property tax increase is needed to construct the Law Enforcement Center addition; by paying off debt for a highway project in 2007 there is room for the debt payment for the LEC Addition without raising the tax rate. 

·          PUBLIC HEARING:  There will be a Public Hearing on the LEC Addition at Logan Middle School on October 2, 2007.

The La Crosse County Planning, Resources and Development Committee, having considered the application filed by:  Chad Vandenlangenberg, Gis Specialist/Enforcement Officer La Crosse County Zoning, Planning and Land Information Department, 400 4th St N – Room 3170 La Crosse WI 54601 and having held a public hearing on the 4th  day of September, 2007 on a petition to terminate Conditional Use Permit No. 502 issued to Robert L. Happel, N9002 Christopherson Rd, Holmen WI 54636, and passed by the County Board on May 18, 2000, to construct pallets, to store lumber and pallets, to store sack feed, seed and farm machinery in 60’ x 64’ proposed building.  Reason for terminating – permit never utilized, the conditional use has been discontinued for a period of 12 consecutive months.  On land that is zoned Exclusive Agricultural District in the Town of Holland on land described as follows:  Described as:  The SE-SE of Section 7, T 18 N, R 7 W.  Town of Holland.  And pursuant to s. 59.69 Wis. The La Crosse County Planning, Resources and Development Committee, having considered the application filed by:  Gerald and Beth Hoth N7103 County Rd EE Bangor WI  54614, and Matt Hoth N6057 Big Creek Rd Bangor WI 54614 and having held a public hearing on the 4th day of September 2007 for a Conditional Use Permit to  operate an outside saw mill on the family farm, with one small storage shed, all of which are east of County Road EE on land that is zoned Exclusive Agricultural District in the Town(s) of Burns on land described as follows:  The fractional NW-NW of Section 3, T 17 N, R 5 W. Town of Burns.  And pursuant to s. 59.69 Wis. Stats. and s. 17.36 Zoning Code: the Committee did publish and receive proof of a Class II notice of the hearing; did receive receipts of mailing of the notices to the affected Town Clerk(s); did hold a public hearing to hear testimony or correspondence from the people; and, did receive and consider action from the affected Town Board(s).  The Committee and the affected Town Board(s), under s. 17.36(4), have the authority to approve the application with integral conditions or to disapprove of the application.  Having considered the entire record the Committee’s recommendation is to:  Approve subject to 4 conditions.  By a unanimous vote, the Committee recommended approval of this Conditional Use Permit subject to 4 conditions.  See Exhibit “A” attached.  The County Board took the following action this 20th day of September, 2007:  Approved subject to conditions as outlined.

Motion by Hammes/Bina to approve as recommended by the Committee.  Discussion ensued.  County Planner Handy responded to questions from the Board.  The ordinance passed on a roll call vote with 26 ayes and 4 nays – Billings, T. Johnson, Burke and Hanson with 5 excused - Belzer, J. Johnson, Hampson, Wood and Maney.

 

ZONING ORDINANCE #Z162-9/07 RE:  PETITION NO. 1753 FILED BY CHAD L. AND KAREN M. MCCATHIE TO REZONE FROM EXCLUSIVE AGRICULTURAL DISTRICT TO AGRICULTURAL DISTRICT “A” IN THE TOWN OF ONALASKA

Stats., has the authority to approve the petition as submitted; to disapprove of the petition; or, to modify and approve the petition.  Having considered the entire record the Committee’s recommendation is to:  Approve as Conditional Zoning.  By a unanimous vote, the Committee recommended approval as Agricultural District “A” Conditional Zoning, subject to the recording of deed restrictions indicating the property can not be further subdivided and use is for one single-family residence.  The Onalaska Town Board and La Crosse County Board must amend their land use plans to show the residential use.  (If this petition is approved as a conditional zoning, deed restrictions must be recorded before zoning takes effect.)  The County Board, under s. 59.69(5)(e)5 Wis. Stats., has the authority to effectuate the petition by ordinance or to disapprove it.  The County Board took the following action this 20th day of September, 2007:  Approved the petition with amendments/conditions, becomes an ordinance, after recording conditions.

Stats.: the Committee did publish and receive proof of a Class II notice of the hearing; did receive receipts of mailing of the notices to the affected Town Clerk(s); did hold a public hearing to hear testimony and official correspondence; and, did receive and consider action from the affected Town Board(s).  The Committee, under s. 59.69(5)(e)4, Wis. Stats., has the authority to approve the petition as submitted; to disapprove of the petition; or, to modify and approve the petition.  Having considered the entire record the Committee’s recommendation is to:  Approve as Conditional Zoning.  By a unanimous vote, the Committee recommended approval of the zoning change to Agricultural District “A” Conditional Zoning, subject to the recording of deed restrictions indicating the parcel can not be further subdivided and the land use is for one single-family residence.  (If this petition is approved as a conditional zoning, deed restrictions must be recorded before zoning takes effect.)  The County Board, under s. 59.69(5)(e)5 Wis. Stats., has the authority to effectuate the petition by ordinance or to disapprove it.  The County Board took the following action this 20th day of September, 2007:  Approved the petition with amendments/conditions, becomes an ordinance, after recording conditions.

RESOLUTION #51-9/07 RE: SUPPORTING CHANGE FOR RETURNING FEDERAL FUNDS FROM CERTIFIED PUBLIC EXPENDITURES OF COUNTY NURSING HOMES

WHEREAS, La Crosse County owns and operates two skilled nursing facilities that provide a safety net for a population that has difficulty securing services elsewhere because of the special and expensive care that is required; and WHEREAS, Lakeview operates at a loss each year because of the difficulty and high cost of providing care, and La Crosse County has been forced to fund approximately $2.3 million per year to supplement the facility’s operating losses; and WHEREAS, the State of Wisconsin claims those losses in reports to the federal government and receives 58% matching funds to compensate for the reported losses under the Certified Public Expenditure (CPE) program; and WHEREAS, the State of Wisconsin claimed approximately $90,000,000 in federal funds for state-wide governmental nursing home losses in budget years 2005-2007, and diverted these funds from counties to the State’s Medicaid Trust Fund; and WHEREAS, the State of Wisconsin decreased supplemental funding from the Intergovernmental Transfer Program (ITP) for governmental nursing homes from $54,773,148 to $37,100,000 and diverted $17,673,148 from counties to the State’s Medicaid Trust Fund resulting in a $540,631 decrease in ITP funds to Lakeview and $290,508 to Hillview.  WHEREAS, the 2007-2009 State Budget proposed by Governor Doyle estimates claiming $77,000,000 in Federal Funds for state-wide governmental nursing home losses and diverting these funds from counties to the state’s Medicaid Trust Fund.  NOW THEREFORE BE IT RESOLVED, that the La Crosse County Board of Supervisors supports returning all Federal funds received from the Certified Public Expenditures of county nursing homes be returned to the county nursing homes in order to bring direct tax relief to the citizens of La Crosse County.

FISCAL NOTE:  Adequate Federal and State reimbursement is extremely important in controlling local property tax levy for our nursing homes.

RESOLUTION #52-9/07  RE:  AUTHORIZATION TO ACCEPT BIDS TO REMODEL FOR A COMMUNITY BASED RESIDENTIAL FACILITY WITHIN LAKEVIEW HEALTH CENTER

WHEREAS, state law continues to require community placement plans for persons with mental illness to increase placement in the community rather than in nursing homes; and, WHEREAS, Lakeview Health Center is one of the primary providers of services to meet the needs of these individuals who are under the care and custody of the La Crosse County Human Services Department; and WHEREAS, bids were received on Friday, August 31, 2007, for remodeling of a portion of the A-Wing at Lakeview Health Center for a Community Based Residential Facility; and, WHEREAS, funds for this project will be borrowed from the General Fund at 5% over 20 years and Lakeview will make monthly payments to repay the loan; and, NOW, THEREFORE BE IT RESOLVED, that the La Crosse County Board does hereby approve the low bid from Market & Johnson in the amount of $273,310 for remodeling of a portion of the A-Wing at Lakeview Health Center for a Community Based Residential Facility.  BE IT FURTHER RESOLVED, that the total project costs will include remodeling of $273,310, Architectural & Engineering fees of $19,132, and a contingency amount of $25,558; total project costs not to exceed $318,000.  BE IT FURTHER RESOLVED, that the County Board Chair is hereby authorized to execute a contract, in accordance with the bid proposals and the bid specifications, after approval by Corporation Counsel.

FISCAL NOTE: Funds will be borrowed from the General Fund for a 20 year term at 5% interest (Maximum Principal amount $318,000; Interest $185,678).

RESOLUTION #53-9/07  RE:  COUNTY PARTICIPATION IN MUNICIPAL TRANSIT UTILITY AND EXPANSION OF SERVICE TO LA CROSSE COUNTY LAKEVIEW AREA

WHEREAS, there is a need for the expansion of bus service transit from the City of La Crosse to certain outlying areas in La Crosse County; and, WHEREAS, there is a desire on behalf of La Crosse County and the City of La Crosse to cooperate in transportation matters on a county-wide basis; and, WHEREAS, the County desires to be further involved in matters involving the City of La Crosse Mass Transit Utility (MTU) and county-wide transit services; and, WHEREAS, it is in the best interests of La Crosse County to expand bus service transit to such areas as Lakeview Health Center and the Lakeview Business Park.  NOW THEREFORE BE IT RESOLVED, that the County Board requests the City of La Crosse to allow the appointment by the County Board Chair of one member from the La Crosse County Board to the MTU Board.  BE IT FURTHER RESOLVED, that County staff work with the City of La Crosse, Village of West Salem, Onalaska-Holmen-West Salem Public Transit (Running, Inc.) and the MTU Board towards the creation of a fixed route service to Lakeview Health Center and the Lakeview Business Park to begin in 2009, as long as such service does not jeopardize any existing shared ride system.  BE IT FURTHER RESOLVED, that the County staff report progress with the creation of such a fixed route service to the La Crosse County Board by June 1, 2008.

FISCAL NOTE:  No immediate funding impact – potentially funded in part by the County from funds in the 2009 budget.

RESOLUTION #54-9/07 RE: AUTHORIZING PREPARATION & SUBMISSION OF A WISCONSIN DEPARTMENT OF COMMERCE COMMUNITY DEVELOPMENT BLOCK GRANT APPLICATION FOR EMERGENCY ASSISTANCE WITH FLOOD DAMAGE

WHEREAS, monies are available under the Community Development Block grant administered by the State of Wisconsin, Department of Commerce for the purpose of emergency assistance; and, WHEREAS, La Crosse County has received a federal disaster declaration as a result of the August 2007 flooding; and, WHEREAS, there has been significant property damage in La Crosse County as a result of this flood that is estimated at $2 million ; and, WHEREAS, La Crosse County is eligible to apply for this grant and county staff will administer the distribution of said grant dollars to La Crosse County Landowners; and, WHEREAS, the La Crosse County Board believes that the best interests of the residents of La Crosse County will be served by utilizing these funds to repair and replace flood damage to property in La Crosse County while taking steps to reduce the potential for additional flood damage in the future.  NOW THEREFORE BE IT RESOLVED, that the La Crosse County Board does hereby authorize the appropriate county staff to assist in the preparation and filing of an application with the Community Development Block Grant Program for Emergency Assistance.

FISCAL NOTE:  The application will request a grant of up to $500,000.

RESOLUTION #56-9/07  RE:  SUPPORT STATE FUNDING OF COMMUNICABLE DISEASE MANDATES FOR LOCAL HEALTH DEPARTMENTS

WHEREAS, pursuant to s. 252.03 Wis. Stats., every local health department must investigate and take all measures necessary to prevent, suppress and control communicable diseases; and, WHEREAS, currently there is no state financial support to reimburse local health departments for the cost of carrying out the state mandates for communicable disease prevention and control; and, WHEREAS, La Crosse County will utilize about $264,000 of local tax levy in 2007 for communicable disease prevention and control efforts.  NOW THEREFORE BE IT RESOLVED, that the La Crosse County Board hereby requests the State of Wisconsin to provide ongoing funding to counties to carry out the duties and responsibilities of local health departments for communicable disease prevention and control that are mandated under Chapter 252 of the Wisconsin Statutes.  BE IT FURTHER RESOLVED, that the La Crosse County Clerk is directed to send a copy of this resolution to Governor James Doyle, State Sen. Dan Kapanke, State Reps. Mike Huebsch and Jennifer Shilling and the Wisconsin Counties Association.

JUDICIARY AND LAW COMMITTEE; LEC ADDITION COMMITTEE:  RESOLUTION RE:  ACCEPTING IN PRINCIPLE THE RECOMMENDATIONS OF THE CAREY GROUP JUSTICE ASSESSMENT

WHEREAS, the Carey Group Justice Assessment final report was presented to the County Board on May 30, 2007 to assist the County in accomplishing the following major objectives:

1.       Maximize the efficiency and effectiveness of the jail function

2.       Ensure that justice sanctions collectively and individually are adequate and cost efficient

3.       Develop a process to make informed decisions

WHEREAS, the La Crosse County Board supports the following specific recommendations:

1.       Remodel and construct an addition to the present Law Enforcement Center that not only          meets our present needs but also includes space to expand in a long-term Master Plan and allows for collaboration among those involved in the criminal justice system

2.       Include both direct and indirect supervision for inmate housing

3.       Provide adequate staffing for the Jail and Justice Sanctions

4.       Adopt evidenced-based practices in achieving risk reduction and developing effective, long-term programming to provide consistent risk/needs assessment and reduce offender recidivism 

5.       Support a collaborative process for making informed decisions

6.       Develop evaluation components to assure quality services, based upon enhancement of integrated  data collection systems to the extent possible

WHEREAS, the County has begun addressing the viability of many recommendations, including:

NOW, THEREFORE BE IT RESOLVED that the La Crosse County Board accepts the Carey Group Justice Assessment final report, supports the specific recommendations listed, and directs County staff to continue to present decisions and options implementing other recommendations.  

FISCAL NOTE:  The financial impact of the Carey report is best identified with the individual policy & budgetary decisions presented to the County Board.

RESOLUTION #57-9/07  RE:  AUTHORIZE SURVEY AND APPRAISAL OF COUNTY RIPARIAN PROPERTY ADJACENT TO CERTAIN LOTS IN THE SHOREWOOD AREA

WHEREAS, the La Crosse County Board authorized the survey, appraisal and sale of county land abutting Lake Neshonoc in the following resolutions:  Resolution #79-1/07 (the Neshonoc Lake area), Resolution #80-1/07 (the Shorewood area) and Resolution #81-1/07 (the Lake Road area); and, WHEREAS, the Wisconsin Department of Natural Resources (DNR) previously determined that the county land in the Shorewood area does provide public access to Lake Neshonoc, a navigable waterway, as a result of abutting public land in the form of a Town of Hamilton park and that any effort by the county to abandon fee title ownership of the parcel would be subject to DNR review and approval pursuant to s. 66.1006, Wis. Stats. and s. NR 1.92, Wis. Adm. Code; and, WHEREAS, the sale of the Shorewood area property in Resolution # 80-1/07 was contingent upon receiving DNR approval; and, WHEREAS, the DNR in an order issued on August 30, 2007 granted the petition of La Crosse County to partially abandon public access to Lake Neshonoc via its lands located in the Shorewood area that is conditioned upon all adjacent property owners who purchase these lands being subject to specified easements granting perpetual public access to the subject property and further providing that these easements shall run with the property in the event of future changes of ownership; and, WHEREAS, Resolutions #79, 80 and 81-1/07 authorized the amount of $25,000 to fund the survey and appraisal costs for the combined Lake Road, Shorewood and Neshonoc Lake projects; and, WHEREAS, the amount of $24,100 has been expended for the survey and appraisal costs in the Lake Road and Neshonoc Lake areas leaving insufficient funds to pay for the survey and appraisal costs of the Shorewood area.  NOW THEREFORE BE IT RESOLVED, that the La Crosse County Board authorizes the transfer of an amount not to exceed $12,000 from the General Fund Operating Contingency to pay the costs of the qualified consultants who were previously hired to survey and appraise the Lake Road and Neshonoc Lake parcels to survey and appraise the Shorewood parcels.  BE IT FURTHER RESOLVED, that the Finance department and other County staff are authorized to do all things necessary to carry out the intent of this resolution and resolution #80-1/07 regarding survey, appraisal and sale of specified County riparian land adjacent to lots 9 – 14 of Shorewood, a subdivision of residential lots, in the Town of Hamilton.

FISCAL NOTE: The expenses for the survey and appraisal of Lake Road and Neshonoc Lake parcels are as follows: Coulee Region Survey - $7,400, Midwest Professional Appraisal - $16,500, and The Title Company - $200 resulting in a total cost of $24,100.  An amount not to exceed $12,000 for the Shorewood area shall be transferred from the General Fund Operating Contingency to Property Management Org. 1085, Appraisal Acct. 64008 and reimbursed to the Fund upon sale of said parcels.

 

PUBLIC WORKS AND INFRASTRUCTURE COMMITTEE

REFERRED RESOLUTION

EXECUTIVE COMMITTEE; PUBLIC WORKS AND INFRASTRUCTURE COMMITTEE:  RESOLUTION RE:  APPROVAL OF AMENDMENT NO. 4 TO THE SOLID WASTE DISPOSAL SERVICE AGREEMENT BETWEEN LA CROSSE COUNTY AND NORTHERN STATES POWER COMPANY REGARDING SALE OF FERROUS MATERIALS

WHEREAS, La Crosse County and Northern States Power Company entered into a Solid Waste Disposal Agreement dated March 18, 1986 for the construction and operation of the Refuse Derived Fuel facility on French Island; and, WHEREAS, the Agreement provides that if Northern States Power Company sells any recovered materials, such as ferrous materials removed from the waste delivered to the facility, that the County and Northern States Power Company share equally in the net revenues; and, WHEREAS, La Crosse County and Northern States Power Company desire to pursue the sale of ferrous recovered material from acceptable waste and to expand on the provisions in the Agreement to address the sharing of revenues received from the sale of such materials; and, WHEREAS, the Amendment will also provide that the County will pay for any net costs incurred by Northern States Power Company for the sale of ferrous recovered materials up to a maximum figure advantageous to the County, which may be revised from time to time.  NOW THEREFORE BE IT RESOLVED, that the La Crosse County Board authorizes the County Board Chair and County Clerk to execute an Amendment No. 4 to the Solid Waste Disposal Service Agreement in accordance with the above terms, after approval by Corporation Counsel.

FISCAL NOTE:  Estimated revenues up to $10,000/year to be deposited in new Ferrous Revenue account. Costs or expenses paid by reduced landfill operational costs and state fees, resulting in no net cost to the County.

AMENDMENT NO. 1 TO MUNICIPAL REVENUE SHARING AGREEMENT BETWEEN THE VILLAGE OF WEST SALEM AND THE COUNTY OF LA CROSSE  RE:  WEST SALEM INCREMENTAL DISTRICT #1

WHEREAS, the County of La Crosse and the Village of West Salem entered into a Municipal Revenue Sharing Agreement effective November 21, 2006 regarding West Salem Tax Incremental District #1; and, WHEREAS, the Agreement concerns certain lands to be included with the boundaries of that District; and, WHEREAS, the County of La Crosse and the Village of West Salem desire to amend the Agreement to include additional lands as part of the Tax Incremental District #1.  NOW, THEREFORE, in consideration of the mutual promises and agreements of the Village and the County, the receipt and sufficiency of which is mutually acknowledged, the parties agree to amend the Agreement as follows:

1.                   Creation of Tax Incremental District #1.  The village agrees to create the West Salem Tax Incremental District #1 (hereinafter “TID #1”), with a legal description of lands to be included in the boundaries of TID #1 being attached hereto as Exhibit “A” and “B:, by approving the project plan for TID #1 and adopting a resolution creating TID#1 for Phase 1b for the lands described in Exhibit “A” and a resolution to amend TID #1 to include the property described in Exhibit “B” of the Lakeview Business Park.

2.                   Financing of project costs.  The county agrees to finance the development of the infrastructure for the lands described in Exhibits “A” and “B” of the Lakeview Industrial Park through the issuance of bonds or other debt authorized by the County Board.

3.                   Revenue Sharing.  The Village agrees to pledge 100% of the tax increment revenues arising out of the lands described in Exhibit “A” and in Exhibit “B” to the County over a minimum period of ten years to pay the County for the project costs of TID #1 as provided in the original agreement.

4.                   All other terms and provisions contained in the original Agreement shall remain in full force and effect, except where inconsistent with this Amendment.

IN WITNESS WHEREOF, the parties hereto have caused the execution of this Amendment to the Agreement by authority of their respective governing bodies effective as of the date when all the parties hereto have affixed their respective signatures.

Motion by T. Johnson/Hammes to approve.  Discussion ensued.  The motion to approve the map passed on a unanimous voice vote with 6 excused - Belzer, J. Johnson, Hampson, Wood, Maney and Montgomery.

 

FUTURE AGENDA ITEMS

BINA – The man who processes deer for the food pantries wants more money per deer or will not continue to process.  Supervisor Bina thinks the County should get involved to solve this problem.
